BROOKINGS COUNTY COMMISSION MEETING
Tuesday, January 14, 2003

The Brookings County Board of County Commissioners met in regular session on Tuesday, January 14, 2003, with the following members present: Emil Klavetter, Deanna Santema, Dennis Falken, and Mary Negstad.  Don Larson was absent attending meetings in Pierre, SD.  Also present: Stephanie Vogel, Kelly Bakken, Phyllis Lakman, Pat Fishback, Dick Smith, Donna Ramsay, Doris Roden, Elizabeth Williams, Wm. Mark Kratochvil, Ted Eggebraaten, and Vicki Hanna.

Chairperson Emil Klavetter called the meeting to order.

APPROVAL OF AGENDA / MINUTES
Motion by Santema, seconded by Negstad, to approve the agenda for January 14, 2003 meeting as amended.  All voting “Aye.”  Motion by Santema, seconded by Falken, to approve the minutes for the January 7, 2003 meeting approved as mailed.  All voting “Aye.”

COMMISSION REPORTS
Commissioner Negstad reported on the Brookings Area Transit meeting.  Commissioner Santema reported on the Final Walk Through on the 2nd Floor Courthouse Construction, the East Central Mental Health meeting, and the Retirement Party for Commissioners Kneip and Telkamp.  Commissioner Klavetter reported on the Final Walk Through on the 2nd Floor Courthouse Construction, the Planning & Zoning meeting, the E911 Council meeting, and the Retirement Party for Commissioners Kneip and Telkamp.

OTHER MATTERS
Motion by Falken, seconded by Negstad, to approve the recommendations of the Brookings County Welfare Director for the following applications for County assistance.  All voting “Aye.”  Case # 03-005 for rent was approved; Case # 03-001A for utilities was approved.

Motion by Falken, seconded by Santema to approve the following travel and education requests.  All voting “Aye.”  Zoning & Drainage Director, David Rusten to go to Pierre, SD on January 13-15, 2003 to attend the Stock Growers Conference.

Deputy Auditor, Kelly Bakken presented the board with the Auditors Report.  Bakken updated the board on the upcoming 2003 Election for a County Commissioner Representative to the SDRS Board of Trustees.

Be it noted, the Highway transfers for the month of December 2002, $10,747.47 was transferred for expenditures to increase the Highway budget due to work performed and supplies furnished for various non-highway departments.

Motion by Negstad, seconded by Santema, to approve for recording purposes
and authorize the chair to sign Resolution # 03-03.  The plat of Lot 1, Wheeler Addition in N1/2 of NW1/4 of Section 11-110-49, Brookings County, South Dakota.  All voting “Aye.”

Motion by Falken, seconded by Negstad, to approve for recording purposes and authorize the chair to sign Resolution # 03-04.  The plat of Lot 13 of Dakota Shores Subdivision located in Government Lot 5 of Section 15-112-47, Brookings County, South Dakota.  All voting “Aye.”

Motion by Falken, seconded by Negstad, to approve and authorize the Chair to sign the Probationary Leave Request Form for Deputy Sheriff, Mark Anawski to use 8 hours of Sick Leave in January 2003.  All voting “Aye.”

Chair Klavetter updated the board on the grant for the State radio tower project and discussed a Courthouse carpet request.

Commission Assistant/Personnel Director, Stephanie Vogel presented the board with the Commission Assistant/Personnel Director Report.  Vogel updated the board on Policy Changes, County Day in Pierre, SD, SD State Historical Society extension for the 1921 Building, Hospital Board Appointment information, and the 911 Coordinator Position.

Motion by Falken, seconded by Negstad, to adopt Policy 3.2.3 ‘Drug & Alcohol Policy for Safety Sensitive Positions.  All voting “Aye.”

Motion by Falken, seconded by Negstad, to go into executive session at 9:10am.  All voting “Aye.”  Chair Klavetter declared executive session over at 9:48am.  Reason – Personnel Matters.  No action at this time.  Also present:  Martin Stanwick and Steven Tietjen.

Motion by Falken, seconded by Santema, to place Assistant Chief Deputy @ $38,188.80 to accommodate a discrepancy in the supervisory chain.  All voting “Aye.”

Highway Superintendent, Ted Eggebraaten met with the board to discuss Highway matters.  Updating the board on the 1921 Building parking lot project, the tree trimming and removal project on North Highway 77, County Road 23 project, the State of South Dakota Gravel Pits, the Storm Water Permit, and the upcoming NACE Conference.

Motion by Santema, seconded by Falken, to authorize the Chair to sign the Application with Department of Environment and Natural Resources Notice of Intent (NOI) to Obtain Coverage Under the SWD General Permit for Storm Water Discharges Associated with Industrial or Construction Activities.  The application will be signed by the Chair upon completion by Highway Superintendent, Ted Eggebraaten.  All voting “Aye.”

Executive Director of the Brookings Economic Development Corporation, Dick Smith met with the board to discuss the Transfer Agreement for the 1921 Building.  Motion by Negstad, to table the 1921 Building Transfer Agreement for two weeks.  Motion failed, due to the lack of a second.  The Board of County Commissioners, Dick Smith and Deputy States Attorney, Wm. Mark Kratochvil discussed several concerns with the Transfer Agreement. Motion by Falken, seconded by Santema, to approve and authorize the Chair to sign the Transfer Agreement for the 1921 Building, the Transfer Agreement is between the Brookings County, South Dakota and the Brookings Economic Development Corporation.  All voting “Aye.”

Treasurer, Vicki Hanna met with the board to discuss 2002 Mobile Home Distress Warrants.  Motion by Santema, seconded by Negstad, to authorize the Treasurer to proceed with the Brookings County Sheriff in processing the 2002 Mobile Home Distress Warrants.  All voting “Aye.”

Commission Assistant/Personnel Director, Stephanie Vogel presented the board with Resolution # 03-02.  A Resolution titled The 2003 Authorized Exempt Employees Salary Schedule and Placement.  Motion by Falken, seconded by Negstad, to approve and authorize the Chair to sign Resolution # 03-02.  All voting “Aye.”

The Chair declared the meeting adjourned until 8:30am Tuesday, January 21, 2003.
