The Brookings County Board of County Commissioners met in regular session on Tuesday, November 18, 2003, with the following members present: Emil Klavetter, Deanna Santema, Mary Negstad, Donald Larson and Dennis Falken. Also present: Stephanie Vogel, Stacy Steffensen, Todd Struwe, Robert Hill, Lionel Torgrude, Ted Eggebraaten, Martin Stanwick, Joyce Dragseth, Rose Stee, Mel Kloster, Laurie Tangen, and Gary Heldt.
Chairperson Klavetter called the meeting to order.
CONSENT AGENDA
Chairperson Klavetter declared the Consent Agenda approved without
objection from the board. The Consent Agenda consisted of the agenda
for the November 18, 2003 Commission Meeting, and the minutes from the

Emergency Management Director Todd Struwe updated the board on correspondences
from the South Dakota Department of Public Safety, Homeland Security funding
and bids and budget matters.

from Ed M. Feld Equipment Company of Carroll, IA, in the amount of $122,000
for a self-contained breathing apparatus. Roll call vote: Santema

Zoning and Drainage Supervisor Robert Hill presented the board
with the October Building Permit Report. He also updated the board
on a flood plain permit and concerns about a building project in Elkton
Township.

Bortnem North Shore Cove located in the NE ¼ of Section 29, T109N,

Commission Assistant/Personnel Director, Stephanie Vogel, presented the board with the Commission Assistant/Personnel Director Report. Be it noted, the board approved Personnel Action Notices for welder/fabricator Dennis Miller, Zoning/Drainage part-time office assistant Terri Bortnem, and Accounts Payable Clerk Ruth Sapp. Vogel updated the board on union negotiations; the pocket gopher resolution; a draft resolution to change the State’s Attorney’s position from part-time to full-time; and correspondences from the South Dakota Department of Public Safety, Natural Resources Conservation Service and the South Dakota Department of Health. Vogel also updated the board on the Festival of Lights Courthouse Open House.

As scheduled, Highway Superintendent Ted Eggebraaten met with the board
for a Public Hearing for the Second Reading of proposed Ordinance #2003-3
establishing a 45 mile-per-hour speed limit upon a portion of County Road
23. Chairperson Klavetter opened the Public Hearing and read the
proposed ordinance. The board heard comments from Eggebraaten and
Sheriff Martin Stanwick. Chairperson Klavetter closed the Public
Hearing. Motion by Santema, seconded by Negstad, to approve Brookings
County Ordinance #2003-3, an ordinance establishing a 45 mile-per-hour
speed limit on a portion of County Road 23. Roll call vote: Falken

ORDINANCE NUMBER 2003-03
AN ORDINANCE ESTABLISHING A 45 MILE PER HOUR SPEED LIMIT UPON
A PORTION OF COUNTY ROAD 23
WHEREAS, Pursuant to SDCL 32-24-9.1, the Board of County Commissioners may determine and establish speed zones upon all or any part of the highways under its jurisdiction; and
WHEREAS, because of the high volume of traffic; the large number of entrances and exits to and from residences; and the nature and condition of the road involved, it appears necessary to reduce the speed limit on a portion of Brookings County Road 23 to provide for the safety and welfare of all residents and travelers on such road.
THEREFORE, BE IT ORDAINED, that a speed limit of 45 miles per hour be
and the same is hereby established on that portion of Brookings County
Road 23 commencing at the intersection of Brookings County Road 23 and
U.S. Highway 14 and continuing south to the north municipal limits of the
City of Aurora, Brookings County, South Dakota.

Brookings County Extension Agents Mel Kloster, Rose Stee and Laurie
Tangen updated the board on Extension Matters.
Motion by Santema, seconded by Falken, to amend Resolution #03-49,
a Resolution establishing a Bounty Program for Pocket Gophers in Brookings
County. After board discussion, Santema withdrew her motion and Falken
withdrew his second. Be it noted, the board will provide Commission
Assistant Stephanie Vogel with all possible amendments to Resolution #03-49
and the board will have further discussion and possibly take action on
the Resolution at their December 16, 2003 meeting.
COMMISSIONER’S OPEN DISCUSSION
Be it noted, the board discussed union negotiations, the day after
Thanksgiving and Christmas Eve, the Family Medical Leave Act, correspondence
from the South Dakota Department of Public Safety, the Research Park and
a study of full-time versus part-time State’s Attorneys throughout the
state.
The board recessed for lunch and for a document imaging demonstration.
EXECUTIVE SESSION
Motion by Negstad, seconded by Santema, to enter into executive session
at 2:53 p.m. Roll call vote: Santema “Aye,” Negstad “Aye,” Larson
“Aye,” Falken “Aye,” Klavetter “Aye.” Motion passes. Commission
Assistant/Personnel Director Stephanie Vogel was present during the executive
session. Chairperson Klavetter declared the executive session over
at 4:00 p.m. Reason: personnel and contractual. No action was
taken at this time.
