BROOKINGS COUNTY COMMISSION MEETING
Tuesday, December 9, 2003

The Brookings County Board of County Commissioners met in regular session on Tuesday, December 9, 2003, with the following members present: Emil Klavetter, Deanna Santema, Dennis Falken, Donald Larson, and Mary Negstad. Also present: Stephanie Vogel, Kelly Bakken, Robert Hill, Vicki Hanna, Ted Eggebraaten, Brad Wermers, Barbara Telkamp, Wm. Mark Kratochvil, Clyde Calhoon, John Mills, Richard Smith, Steve Rames, Martin Stanwick.

Chairperson Emil Klavetter called the meeting to order.

CONSENT AGENDA
Chairperson Emil Klavetter declared the Consent Agenda approved as amended with no objection from the board. The Consent Agenda consisted of the agenda for the December 9, 2003 Commission Meeting, and the minutes from the December 2, 2003 Commission Meeting.  Welfare Matters: Case # 03-135 for utilities was approved; Case # 03-136 for funeral was denied; Case # 03-137 for medical was denied.  Travel/Education:  Rose Marie Stee to go to Sioux Falls, SD on January 5, 2003 to attend a 4-H Judging Meeting, to go to Chicago, Ill on February 22-24, 2004 to attend JCEP Meeting.  Joyce Dragseth to go to Pierre, SD on December 12, 2003 to attend the SDAAO Executive Board and SDACC Meetings.  Robert Hill to go to Chamberlain, SD on December 17, 2003 to attend the SD Emergency Management Association Meeting.

Commissioner Falken reported on the Festival of Lights Events.

Commissioner Negstad reported on the Brookings Area Transit Authority Meeting.

Commissioner Santema reported on the Festival of Lights Events.

Commissioner Klavetter reported on the Brookings Economic Development Corporation Meeting.

Deputy Auditor, Kelly Bakken presented the board with the Auditors Report.

Be it noted, the Highway transfers for the month of November 2003 in the amount $3,339.05, was transferred for expenditures to increase the Highway budget due to work performed and supplies furnished for various non-highway departments.

Commissioner Larson joined the meeting.
 
 
 
 

Commission Assistant/Personnel Director, Stephanie Vogel presented the board with the Commission Assistant/Personnel Director Report.  Vogel updated the board on the Resolution Designating the State’s Attorney Position As Full-Time and 1921 Building information.

Zoning & Drainage Director, Robert Hill met with the board to submit the following plats for approval.

Motion by Santema, seconded by Falken, to approve for recording purposes Resolution 03-54.  A Resolution for the plat of Block 4 and Block 5 Hanson Addition in the N1/2 of the NW1/4 of Section 15-112-47 in the County of Brookings, South Dakota. Role Call Vote: Larson “Aye,” Negstad “Aye,” Santema “Aye,” Falken “Aye,” Klavetter “Aye.”  Motion passes.

Motion by Falken, seconded by Negstad, to approve for recording purposes Resolution 03-55.  A Resolution for the plat of Hoyer Addition located in the SW1/4 of Section 7-112-52 in the County of Brookings, South Dakota. Role Call Vote: Negstad “Aye,” Santema “Aye,” Falken “Aye,” Larson “Aye,” Klavetter “Aye.”  Motion passes.

Highway Superintendent, Ted Eggebraaten and Brad Wermers with Banner Associates Inc. met with the board to discuss Highway matters.  Eggebraaten updated the board on the County Road # 23 project and on information concerning DME Rail Road Crossings.

Director of Equalization, Joyce Dragseth met with the board to discuss a ProMap Corporation GIS Agreement.  Motion by Negstad, seconded by Falken, to approve and authorize Chair Klavetter to sign the Agreement between ProMap Corporation and Brookings County for Arc View and GIS products and services.  Role Call Vote: Santema “Aye,” Falken “Aye,” Larson “Aye,” Negstad “Aye,” Klavetter “Aye.”  Motion passes.
 
 
 
 
 
 
 
 
 
 
 
 
 
 
 
 
 
 
 
 
 

Treasurer, Vicki Hanna met with the board to discuss Resolution # 03-53.  Motion by Larson, seconded by Santema, to approve and authorize Chair Klavetter to sign Resolution # 03-53, as Resolution Placing Mobile Home Taxes on an Uncollectable List. Role Call Vote: Falken “Aye,” Larson “Aye,” Negstad “Aye,” Santema “Aye,” Klavetter “Aye.”  Motion passes.
 
 

BROOKINGS COUNTY RESOLUTION # 03-53
 

WHERES, South Dakota Codified Law (SDCL) 10-22-30 requires the County Treasurer to present a list of all distress warrants returned by the Sheriff uncollectable to the Board of County Commissioners.  The board has examined such returns and, is satisfied with reports from Sheriff’s and Treasurer that the taxes described in any such warrant cannot be collected.

NOW THEREFORE, BE IT RESOLVED by the Brookings County Commissioners, at a regular meeting December 9, 2003 direct the County Treasurer to place these mobile home taxes on an uncollectable list and no distress warrant shall therefore be issued until it is determined either by the Board of County Commissioners or the County Treasurer that such taxes have become or may have become collectable.  There will be a complete listing of these uncollectable mobile home taxes on file in the Brookings County Treasurers office.

States Attorney, Clyde Calhoon and Deputy States Attorney, Wm. Mark Kratochvil met with the board to discuss Resolution # 03-56.  Motion by Falken, seconded by Larson, to approve and authorize Chair Klavetter to sign Resolution # 03-56.  A Resolution Designating the State’s Attorney Position As Full-Time. Role Call Vote: Larson “Aye,” Negstad “Aye,” Santema “Aye,” Falken “Aye,” Klavetter “Nye.”  Motion passes.
 
 

RESOLUTION # 03-56

A RESOLUTION DESIGNATING THE
STATE’S ATTORNEY POSITION
AS FULL-TIME
 

WHEREAS, Brookings County pursuant to SDCL 7-7-12 may designate the position of State’s Attorney as a full-time position, and

WHEREAS, due to the increased work load and time requirements of such office it appears that the position of State’s Attorney should be full-time effective for the next term of office of such position.

THEREFORE, BE IT RESOLVED by the Brookings County Board of County Commissioners, that the position of Brookings County State’s Attorney is hereby designated as a full-time position effective with the next term of office commencing January 1, 2005.

John Mills, Representative for the 1921 Building met with the board to discuss the 1921 Building Transfer & Easement Agreement.  Be it noted, the board discussed the Parking Easement, Liability Insurance, the Storage Building owned by Brookings County, and the First Right of Refusal Language.

Deputy States Attorney, Wm. Mark Kratochvil met with the board to present the revised Bus Barn Lease Agreement.  Motion by Falken, seconded by Santema, to approve and authorize Chair Klavetter to sign the revised Bus Barn Lease Agreement between Brookings County and the Brookings Area Transit. Role Call Vote: Negstad “Aye,” Santema “Aye,” Falken “Aye,” Larson “Nye,” Klavetter “Aye.”  Motion passes.

Commission Assistant/Personnel Director, Stephanie Vogel updated the board on a request from the Inter Lakes Community Action Program asking for help from trustees.  Vogel also updated the board on information from the State Election School.

COMMISSIONER’S OPEN DISCUSSION
Be it noted, the board discussed upcoming meetings, State flags for the County Commission Chambers, NACO books, the Brookings County Web Site, and Technology matters.

EXECUTIVE SESSION
Motion by Santema, seconded by Falken, to go into executive session at 10:40am. Role Call Vote: Santema “Aye,” Falken “Aye,” Larson “Aye,” Negstad “Aye,” Klavetter “Aye.”  Motion passes.  Chair Klavetter declared executive session over at 11:10am. Commission Assistant/Personnel Director, Stephanie Vogel was present during the Executive Session.  Reason – Personnel Matters.  No action at this time.

ADJOURNMENT
The Chair declared the meeting adjourned until 8:30am Tuesday, December 16, 2003.
