BROOKINGS COUNTY COMMISSION MEETING
Tuesday, February 25, 2003

The Brookings County Board of County Commissioners met in regular session on Tuesday, February 25, 2003, with the following members present: Emil Klavetter, Deanna Santema, Dennis Falken, Don Larson and Mary Negstad. Also present: Stephanie Vogel, Kelly Bakken, Ted Eggebraaten, Joyce Dragseth, David Rusten, and Dan Hanson.

Chairperson Emil Klavetter called the meeting to order.

APPROVAL OF AGENDA / MINUTES

Motion by Santema, seconded by Negstad, to approve the agenda for February 25, 2003 meeting as amended.  All voting “Aye.”  Motion by Negstad, seconded by Falken, to approve the minutes for the February 18, 2003 meeting approved as mailed.  All voting “Aye.”

COMMISSION REPORTS
Commissioner Larson reported on the VeraSun Groundbreaking Ceremony.  Commissioner Negstad reported on the subcommittee meeting to review applications.  Commissioner Santema reported on the VeraSun Groundbreaking Ceremony, Leadership Brookings, and the subcommittee meeting to review applications.  Commissioner Klavetter reported on the Brookings Economic Development Corporation meeting, VeraSun Groundbreaking Ceremony, Leadership Brookings, and the subcommittee meeting to review applications.

OTHER MATTERS
Motion by Larson, seconded by Negstad, to approve the recommendations of the Brookings County Welfare Director for the following applications for County assistance. Case # 03-025 for medical assistance was denied; Case # 03-026 for rent was approved.  All voting “Aye.”

Motion by Negstad, seconded by Falken to approve the following travel and education requests. Highway Superintendent, Ted Eggebraaten to go to Chamberlin, SD on March 11-13, 2003 to attend the Highway Superintendents Shortcourse.  All voting “Aye.”

Deputy Auditor, Kelly Bakken presented the board with the Auditors Report, distributing the Brookings County 2002 Annual Report.  Motion by Larson, seconded by Santema, to approve and authorize the Chair to sign the Probationary Leave Request Form for States Attorney’s Office Assistant, Candace Stamp to use 1 hour of Vacation in February 2003; Senior Maintenance Worker, Mark Halvorson to use 16 hours of Sick Leave in February 2003.  All voting “Aye.”

Commission Assistant/Personnel Director, Stephanie Vogel presented the board with the Commission Assistant/Personnel Director Report.  Vogel updated the board on the City of Brookings Annexation Resolution and the Pre-Disaster Mitigation Plan from First District Association of Local Governments.

Highway Superintendent, Ted Eggebraaten met with the board to discuss Highway and Bridge matters.

Motion by Larson, seconded by Negstad, to approve and authorize the chair to sign the 2003 Joint Work Agreement Between Brookings County, South Dakota and Moody County, South Dakota.  All voting “Aye.”

Motion by Santema, seconded by Negstad, to approve and authorize the chair to sign the Application for Occupancy on the Right of Way of County Highway, an application made by Interstate Telecommunications Coop, Inc. for project # 538”50.”  All voting “Aye.”

Motion by Falken, seconded by Santema, to approve and authorize the chair to sign Resolution # 03-07, the Brookings County Weight Limit Enforcement Resolution.  All voting “Aye.”

Resolution # 03-07

WHEREAS, seasonal climatic changes can be detrimental to our highways, and

WHEREAS, the Brookings County Board of County Commissioners desires to protect existing Brookings County Highways, ultimately saving tax dollars and,

WHEREAS, the Brookings County Board of County Commissioners, desire the enforcement of weight limitations on Brookings County Roads as set forth and posted by the Brookings County Highway Superintendent.

NOW THEREFORE BE IT RESOLVED:

WHEREAS, the limits on Brookings County highways shall be set as six (6) and seven (7) ton per axle, on all asphalt surface roads, during spring thaw period and when limit signs are in place.
That the South Dakota Highway Patrol be and hereby is authorized and requested to enforce weight limitations on Brookings County Roads.

BE IT FURTHER RESOLVED, that the penalty for the violation of the load restrictions shall be set forth in SDCL 32-22-55.

Motion by Santema, seconded by Falken, to declare to surplus property, and to authorize the process of sealed bids for resale:  1994 Caterpillar Four-Wheel Drive Loader, model 950F, serial number 8TK00905, county number 2507.  All voting “Aye.”

The board discussed the County Road 23 project.  Motion by Negstad, seconded by Larson, to approved and authorize the chair to sign the Right of Way Certificate, Utilities Certificate, and the Letting Authorization for Project number P 6317(00), PCN 6734 Brookings County.  Roll Call Vote:  Falken ~ ”Aye;” Larson ~ ”Aye;” Negstad ~ ”Aye;” Santema ~ ”Aye;” Klavetter ~ ”Aye.”  Motion passes.

Deputy Director of Equalization, met with the board to present the following applications for abatement.

Motion by Larson, seconded by Falken, to approve and authorize the chair to sign Abatement # 04-03, Tom Kersting, E1/2, S1/2, SE1/4 of section 10-109-52 (10980-10952-104-00) 2002 abatement in the amount of $656.00.  Reason:  Storm damage to property.  All voting “Aye.”

Motion by Falken, seconded by Santema, to approve and authorize the chair to sign Abatement # 05-03, McLeod USA, Building on leased site lot 1-2 NW1/4 exc. H-2 of section 18-111-49 (01990-11149-182-10) 2002 abatement in the amount of $139.18.  Reason:  Taxes paid through gross receipt taxes.  All voting “Aye.”

Zoning and Drainage Director, David Rusten, and Brookings City Representative, Dan Hanson met with the board to discuss Resolution # 03-08.  A Resolution Approving Annexation of Territory by the City of Brookings.  Motion by Santema, seconded by Negstad, to approve and authorize the chair to sign Resolution # 03-08.  All voting “Aye.”

Resolution # 03-08

A RESOLUTION APPROVING ANNEXATION OF TERRITORY BY THE CITY OF BROOKINGS

WHEREAS, the City of Brookings desires to annex the following described property, to wit:

The south one-half of SE1/4 of Section 18-T110N-R49W except the platted areas thereof and except the E720’ thereof.

WHEREAS, pursuant to SDCL 9-4-5, such annexation is subject to review by the Board of County Commissioners.

THERFORE, BE IT RESOLVED by the Brookings County Board of County Commissioners, that the annexation of the above described territory by the City of Brookings be and the same is hereby approved.

Motion by Falken, seconded by Negstad, to go into executive session at 9:51am.  All voting “Aye.”  Chair Klavetter declared executive session over at 10:55am.  Reason – Personnel Matters.  No action at this time.

ADJOURNMENT
The Chair declared the meeting adjourned until 8:30am Tuesday, March 4, 2003.
