BROOKINGS COUNTY COMMISSION MEETING
Tuesday, March 11, 2003

The Brookings County Board of County Commissioners met in regular session on Tuesday, March 11, 2003, with the following members present: Emil Klavetter, Deanna Santema, Don Larson, Dennis Falken, and Mary Negstad.  Also present: Stephanie Vogel, Kelly Bakken, Joyce Dragseth, C. Beryle Sessions, Kyle Helseth, Lawrence Groon, Robert Fedrickson, John Fuhr, Gary R. Madsen, Chris Lee, Nancy Price, Patty Solsaa, Marty Hendricks, Ted Eggebraaten, Brad Wermers, Daryl Englund, Lyle Bothe, Lance Bothe, Larry Bothe, and David Rusten.

Chairperson Emil Klavetter called the meeting to order.

APPROVAL OF AGENDA / MINUTES
Motion by Falken, seconded by Negstad, to approve the agenda for March 11, 2003 meeting as amended.  All voting “Aye.”
Motion by Larson, seconded by Negstad, to approve the minutes for the March 4, 2003 meeting approved as mailed.  All voting “Aye.”Motion by Larson, seconded by Santema, to approve the minutes for the March 7, 2003 special meeting approved as mailed.  All voting “Aye.”

OTHER MATTERS
Motion by Santema, seconded by Larson, to approve the recommendations of the Brookings County Welfare Director for the following applications for County assistance. Case # 03-002HSC for admission fee was approved; Case # 03-033 for Cobra insurance premium was approved.  All voting “Aye.”

Motion by Santema, seconded by Negstad to approve the following travel and education requests. Weed and Pest Employees, Gary Heldt and Larry Barnett to go to Pierre, SD on April 1-2, 2003 to attend the Weed and Pest Supervisor and Enforcement Training.  All voting “Aye.”

Deputy Auditor, Kelly Bakken presented the board with the Auditors Report, and distributed the Brookings County Budget as of February 2003.

Commission Assistant/Personnel Director, Stephanie Vogel presented the board with the Commission Assistant/Personnel Director Report.  Vogel updated the board with information on the NACO Convention, FLSA Record Keeping for Hourly Employees, and Roberts Rules of Order.

Lawrence Groon met with the board to discuss the difference in the assessments between property adjacent to Brookings County and Kingsbury County.  Groon requested the board to research South Dakota Codified Laws 10-11-47 and 10-11-48 and make a formal request to the Department of Revenue.  Also present:  Robert Fredrickson, John Fuhr, Gary R. Madsen, Chris Lee, C. Beryle Sessions, Joyce Dragseth, and Kyle Helseth.

Department of Revenue Representative, Kyle Helseth met with board to discuss abatement application matters.

Highway Superintendent, Ted Eggebraaten and Banner Associates, Inc. Representatives, Daryl Englund and Brad Wermers met with the board to present the bids for the County Road 23 Project.  Motion by Larson, seconded by Falken, to award the bid for the Brookings County Highway 23 Improvements Project to Irving F. Jensen Co. Inc., of Sioux City, Iowa in the amount bid of $3,889,063.63.  Be it noted, the bid is subject to the final approval of the Department of Transportation.  Role call vote:  Falken ~ “Aye;” Larson ~ “Aye;” ~ Negstad ~ “Aye;” Santema ~ “Aye;” Klavetter ~ “Aye.”  Motion passes.

City of Aurora Representatives, Nancy Price, Patty Solsaa, and Marty Hendricks met with the board to discuss the Brookings County Highway 23 Improvements Project and concerns with the improvements of the railroad crossing within the City of Aurora.

Highway Superintendent, Ted Eggebraaten informed the board that as of 8:00am on Wednesday, March 12, 2003 Brookings County Highways shall have weight limits set as six (6) and seven (7) ton per axle, on all asphalt surface roads, during spring thaw period and when limit signs are in place.  The South Dakota Highway Patrol is authorized and requested to enforce weight limitations on Brookings County roads.  The Penalty for the violation of the load restrictions shall be as set forth in SDCL 32-22-55.

Highway Superintendent, Ted Eggebraaten updated the board on the progress of the clean up project in the City of Sinai.

Lyle Bothe, Lance Bothe, and Larry Bothe met with the board to discuss and request action on the trees that are planted in the right-of-way in Section 25, of Trenton Township.  Be it noted, David Rusten was also present, and will act on this matter.

Zoning and Drainage Supervisor, David Rusten met with the board to discuss departmental matters.  Rusten inquired if the board would be in need of his professional services after his retirement on March 31, 2003.

Motion by Negstad, seconded by Santema, to approve for recording purposes
Resolution # 03-09.  The plat of Lots 10, 11, and 12 in Highland Addition in Government Lot 4 of Section 28-109-50, Brookings County, South Dakota.  All voting “Aye.”

Chair Klavetter updated the board that he will not be present for the next scheduled Brookings County Commission meeting on Tuesday, March 18, 2003.

Be it noted, the board discussed the basics and the usage of the Roberts Rules of Order.

Motion by Negstad, seconded by Falken, to go into executive session at 10:28am.  All voting “Aye.”

The board recessed from executive session at 12:10pm until 1:00pm for lunch.

Chair Klavetter declared executive session over at 1:34pm.  Reason – Personnel  Matters.  No action at this time.

Motion by Falken, seconded by Santema, to appoint Robert Hill as the Director of Zoning and Drainage at the wage rate of $31,370.00 beginning March 31, 2003.  All voting “Aye.”  Motion carried.

ADJOURNMENT
The Chair declared the meeting adjourned at 1:40pm, until 8:30am Tuesday, March 18, 2003.
