BROOKINGS COUNTY COMMISSION MEETING
Tuesday, March 25, 2003

The Brookings County Board of County Commissioners met in regular session on Tuesday, March 25, 2003, with the following members present: Emil Klavetter, Dennis Falken, and Mary Negstad. Deanna Santema was absent attending the NACE Conference.  Don Larson was absent for personal reasons.  Also present: Stephanie Vogel, Kelly Bakken, David Rusten, Joseph Hemmen, and Judy Hemmen.

Chairperson Emil Klavetter called the meeting to order.

APPROVAL OF AGENDA / MINUTES
Motion by Negstad, seconded by Falken, to approve the agenda for March 25, 2003 meeting as amended.  All voting “Aye.”  Motion by Falken, seconded by Negstad, to approve the minutes for the March 18, 2003 meeting approved as mailed.  All voting “Aye.”

COMMISSION REPORTS
Commissioner Falken reported on the New Officials Conference.  Commissioner Negstad reported on the New Officials Conference, Volunteer Service Bank Meeting, and the receptions for David Rusten and Todd Struwe.  Commissioner Klavetter updated the board on retirement socials for C. Beryle Sessions and David Rusten.

OTHER MATTERS
 Motion by Falken, seconded by Negstad, to approve the recommendations of the Brookings County Welfare Director for the following applications for County assistance. Case # 03-036 for utilities was approved; Case # 03-037 for clinic bill was denied; Case # 03-003HSC for admission fee was approved; Case # 03-029 for hospital bill was denied; Case # 03-020 for hospital bill was denied; Case # 03-014 for hospital bill was denied; Case # 03-023 for hospital bill was denied; Case # 03-032 for hospital bill was approved; Case # 03-039 for rent was approved.  All voting “Aye.”
 
 Motion by Negstad, seconded by Falken to approve the following travel and education requests.  Deputy Sheriff, Steve Haro to go to Sioux Falls, SD on April 22, 2003 to attend the Missing and Abducted Children Investigation Program.  Veterans/Welfare Department Head, Lionel Torgrude and Deputy Auditor, Kelly Bakken to go to Pierre, SD on March 26-27, 2003 to attend HIPPA Training. All voting “Aye.”

 Deputy Auditor, Kelly Bakken presented the board with the Auditors Report.

Commission Assistant/Personnel Director, Stephanie Vogel presented the board with the Commission Assistant/Personnel Director Report.  Vogel updated the board on the following matters: the Petition to vacate platted street, the Resolution requesting equalization, the LEOP & PDM Agreements, the Abatement request for owner-occupied status, the letter of interest for the vacant position on the Zoning Board, the Hovey baby reception, and relayed information from Deene Dayton from Legislative Audit on presenting budget information to the Department Heads.  Vogel presented the board with a letter from the Department of Human Services regarding East Central Mental Health.  Motion by Negstad, seconded by Falken, to authorize the Chair to sign the letter from the Department of Human Services for the “Core Service Agency.”  All voting “Aye.”  Be it noted, Chair Klavetter signed the Report of Personnel Action for State of South Dakota Division of Emergency Management a Resignation Form from Robert Hill.

CHAIR UPDATES
Chair Klavetter updated the board on the Lake Hendricks school district information.

As scheduled, the board held a Public Hearing for discussion and action on the Petition to Vacate a Platted Street.  Motion by Falken, seconded by Negstad, to approve and authorize the chair to sign Resolution # 03-11.  All voting “Aye.”

RESOLUTION 03-11
RESOLUTION BY THE BROOKINGS COUNTY BOARD OF COUNTY COMMISSIONERS

 WHEREAS, Christiansen Investments, Ltd., a Texas limited partnership, with an address of 306 Main Street, Kimball, South Dakota, 57355 (“Christiansen”), is the record owner of the following described real estate to-wit:

Lot M-2 of Warrior Commercial Park Addition to the City of Brookings, County of Brookings, State of South Dakota, and Lot M-2 of Warrior Commercial Park Second Addition to the City of Brookings, County of Brookings, State of South Dakota, all located in the SW¼ of Section 18-T110N-R49W of the 5th P.M (hereafter the “Property”);

 WHEREAS FURTHER, Christiansen has submitted to this Commission a Petition to Vacate the 35' wide strip of land presently platted as 18th Street, lying east of 25th Avenue, and directly north of Lot M-2 of Warrior Commercial Park Second Addition to the City of Brookings, County of Brookings, State of South Dakota (the “Platted Street”), for the reason that it has never been developed and no longer serves any useful public service; and

 WHEREAS FURTHER, this Commission has held a public hearing to decide this matter, and notice of the time and place of such hearing was given in the manner provided by law.

 NOW THEREFORE,

 BE IT RESOLVED that the Platted Street be vacated and all references thereto be removed from the recorded plat of the Property; and

 BE IT FURTHER RESOLVED that this Commission shall file with the Brookings County Register of Deeds a certified copy of this Resolution and any and all other documentation necessary to effect the aforementioned resolution.

 Effective this 25th day of March 2003.

 As scheduled, Zoning/Drainage Supervisor, David Rusten met with the board for a Public Hearing for the First Reading of the proposed change to Section 1208 of the Brookings County Zoning Ordinance.  Chair Klavetter opened the Public Hearing, and read the current Section 1208: Shelterbelt Setback Requirements, and read the proposed change to the Ordinance.  David Rusten explained the change and distributed drawings from the Soil Conservation Service. Chair Klavetter closed the Public Hearing.  Final action will be on Tuesday, April 1, 2003 @ 9:30am.  Also present: Joseph Hemmen, and Judy Hemmen.

 As scheduled, the board discussed the Resolution requesting equalization of properties in the Arlington School District.  Motion by Negstad, seconded by Falken, to approve and authorize the Chair to sign Resolution # 03-10.  All voting “Aye.”

RESOLUTION NO. 03-10
A RESOLUTION REQUESTING EQUALIZATION OF PROPERTIES IN ARLINGTON SCHOOL DISTRICT

WHEREAS, the Arlington School District includes properties located in both Brookings County and Kingsbury County; and

WHEREAS, it appears that it is appropriate and necessary for the Secretary of Revenue to equalize assessments of all property between Brookings County and Kingsbury County located within the Arlington School District, which equalization is authorized pursuant to SDCL 10-11-47;

THEREFORE, BE IT RESOLVED that the Brookings County Board of County Commissioners hereby requests the Secretary of Revenue to equalize the assessment of all properties between Brookings County and Kingsbury County, located within the Arlington School District, pursuant to SDCL 10-11-47.

Emergency Management Director, Todd Struwe and Office Assistant, Robert Hill met with the board to discuss the Local Emergency Operation Plan and Pre-Disaster Mitigation Plan Agreements.  Motion by Falken, seconded by Negstad, to approve and authorize the chair to sign the Agreements between Brookings County and Robert Hill for the Local Emergency Operation Plan and the Pre-disaster Mitigation Plan.  All voting “Aye.”

Commission Assistant/Personnel Director, Stephanie Vogel presented the board with Personnel Matters.  Be it noted, the board discussed and the chair signed the Requests To Fill Vacancy forms for the following positions:  Zoning & Drainage Department: Office Assistant; Director of Equalization Department: Deputy Director: Custodial Department: General Maintenance Worker; Highway and Weed Departments: Truck Driver.

Motion by Negstad, seconded by Falken, to go into executive session at 10:20am.  All voting “Aye.”  Chair Klavetter declared executive session over at 10:45am.  Reason – Personnel and Contractual Matters.  No action at this time.

ADJOURNMENT
The Chair declared the meeting adjourned until 8:30am Tuesday, April 1, 2003.
