BROOKINGS COUNTY COMMISSION MEETING
Tuesday, April 1, 2003

The Brookings County Board of County Commissioners met in regular session on Tuesday, April 1, 2002, with the following members present: Emil Klavetter, Deanna Santema, Donald Larson, Dennis Falken, and Mary Negstad.  Also present: Stephanie Vogel, Kelly Bakken, Stacy Steffensen, Janet Willmott, Vicki Hanna, Ida Slocum, Ted Eggebraaten, Lionel Torgrude, David Rusten, Todd Struwe, Robert Hill, Joyce Dragseth, C. Beryle Sessions, Marvin Sessions, Sandra Rusten, Ray Dorn, Martin Stanwick, Tricia Paulsen, Gary Kirschman, and Steven Carr.

Chairperson, Emil Klavetter called the meeting to order.

APPROVAL OF AGENDA / MINUTES
Motion by Negstad, seconded by Santema, to approve the agenda for April 1, 2003 meeting approved as amended.  All voting “Aye.”  Motion by Santema, seconded by Falken, to approve the minutes for the March 25, 2003 meeting approved as mailed.  All voting “Aye.”  Brookings County Auditor, Janet Willmott read the Oath of Office appointing Joyce Dragseth to the office of Director of Equalization for the County of Brookings, State of South Dakota.

DEPARTMENT HEAD REPORTS
Highway Superintendent, Ted Eggebraaten met with the board to discuss the preconstruction meeting for the Highway 23 project, and the fuel quote process. Kelly Bakken read the following quotes for the Brookings County Highway Department for #2 Premium Diesel Fuel: Ag First Coop, Volga $1.035; Cenex, Elkton $1.046; Martin Oil, Brookings $1.032.  Martin Oil, Brookings was awarded the quote at $1.032.

Treasurer, Vicki Hanna met with the board to discuss the possibility of implementing a credit card system in the office.

Register of Deeds, Ida Slocum met with the board to discuss departmental matters and space needs.

Veterans and Welfare Department Head, Lionel Torgrude met with the board to discuss departmental matters and HIPPA confidentiality information.  Motion by Larson, seconded by Negstad, to approve the recommendations of the Brookings County Welfare Director for the following applications for County assistance. Case # 03-042R for lien released in full was approved; Case # 03-040 for rent was approved; Case # 03-041 for lot rent was approved; Case # 03-022 for emergency medical was denied; Case # 03-031 for emergency medical was denied; Case # 03-043 for hospital was denied; Case # 03-044 for medical was denied; Case # 03-004HSC for admission fee was approved.  All voting “Aye.”

Motion by Larson, seconded by Santema, to approve and authorize the chair to sign the Satisfaction of County Lien and Resolution # 03-12.  All voting “Aye.”
 

RESOLUTION #03-12

WHEREAS, a County Aid Lien in the amount of $2,297.12 purports to exist in favor of Brookings county and against Case # 03-042R as lienee, and

WHEREAS, said lienee has filed an application with the County Auditor stating such facts as provided by Law.

NOW, THEREFORE, BE IT RESOLVED that after due consideration of the circumstances the Board of County Commissioners finds it advisable and proper to authorized the Chairman of the County Board and County Auditor to execute the following:

A compromise and release of the lien in full upon payment of $1,200.00.

OTHER MATTERS
Commissioner Larson updated the board on the Swiftel board meeting.

Motion by Santema, seconded by Negstad, to approve the following travel/education requests.  Extension Educator, Rose Marie Stee to go to Lake Preston, SD on February 5, 2003 to deliver tapes; to go to Madison, SD on April 2, 9, 17, 30, 2003, to attend the FEU Meeting, After School Program, Radio Program at KJAM, and the After School Program.  Extension Educator, Laurie Tangen to go to Watertown, SD on March 26and 31, 2003 to attend the Health Fair/DermaScan, and the Codington County Extension Office FNP Program; to go to Rapid City, SD on April 7-11, 2003 to attend the FNP Conference; to go to Madison, SD on April 4, 2003 to attend the Camp Lakodia Meeting; to go to Aberdeen, SD on April 29, 2003 to attend the Food Preservation Workshop. Sheriff, Martin Stanwick to go to Sioux Falls, SD on April 3-4, 2003 to attend the Police Traffic Services Committees Meetings.  Director of Equalization Employees, Joyce Dragseth, Kris Bothwell, Kurt Schmidt, Larry Klingbile, and new Deputy Director of Equalization to go to Rapid City, SD on May 13-16, 2003 to attend the Annual SDAAO Conference.  All voting “Aye.”

Director of Equalization, Joyce Dragseth and Steven Carr met with the board to discuss the Abatement Applications # 09-03 and # 10-03.  Motion by Negstad, seconded by Santema, to table action on the Abatement Applications # 09-03 and # 10-03 until Tuesday, April 8, 2003.  “Aye” votes ~ Negstad, Santema, Klavetter; “Nye” votes ~ Larson; Abstain ~ Falken.  Motion passes.

As scheduled, the Public Hearing was held on for the 2nd Reading of the proposed change to Section 1208 of the Brookings County Zoning Ordinance.  Chair Klavetter read the proposed change and opened the hearing to public comment.  Retired Zoning and Drainage Supervisor, David Rusten and NRCS Representative, Gary Kirschman spoke on the proposed change.  Chair Klavetter closed the Public Hearing. Motion by Larson, seconded by Santema, to approve and authorize the chair to sign Ordinance # 2003-01.  Role Call Vote:  Falken ~ “Aye;”  Larson ~ “Aye;”  Negstad ~ “Aye;”  Santema ~ “Aye;”  Klavetter ~ “Aye.”  Motion passes.

ORDINANCE 2003-01

AN ORDINANCE PROVIDING FOR THE AMENDMENT OF THE 1997 REVISED ZONING ORDINANCE BY REVISING SECTION 1208 SHELTERBELT SETBACK REQUIREMENTS

WHEREAS, BROOKINGS COUNTY has previously adopted the 1997 Revised Zoning Ordinance; and

WHEREAS, the Brookings County, South Dakota, Board of County Commissioners deems it necessary, for the purpose of promoting the health, safety, and the general welfare of the County, to amend Section 1208 of the 1997 Revised Zoning Ordinance.

THEREFORE, BE IT ORDAINED BY BROOKINGS COUNTY, SOUTH DAKOTA, that the 1997 Revised Zoning Ordinance of Brookings County be amended by revising and changing Section 1208 Shelterbelt Setback Requirements so as to provide as follows:

Section 1208.  Shelterbelt Setback Requirements.

A shelterbelt, consisting of one (1) or more rows shall not be established within one hundred (100) feet of the right-of-way of any road.  Shelterbelts at right angles to roads shall have a minimum setback of fifty (50) feet from the right-of-way.  Shelterbelts parallel or at right angle to an adjoining property line shall maintain the same setbacks as required on the right-of-way.  Shelterbelts may be planted closer to the adjoining property line than required above with the written permission of the adjoining landowner.  Trees used for landscaping the area immediately adjacent to farmsteads and residences are exempt from this regulation.

In all other respects the 1997 Revised Zoning Ordinance shall remain unchanged and is hereby re-ordained.

Chair Klavetter introduced Robert Hill, Brookings County’s new Zoning and Drainage Department Head.

Tricia Paulsen, Coordinator with Spruce up South Dakota met with the board to discuss the Spruce up South Dakota Program within Brookings County.

Chair Klavetter presented retirement recognition plaques to Director of Equalization, C. Beryle Sessions and Zoning and Drainage Supervisor, David Rusten.

Emergency Management Director, Todd Struwe met with the board to discuss Personnel Matters.  Motion by Negstad, seconded by Falken, to approve, and authorize to advertise for the new position of Deputy Director of Emergency Management, a fulltime position @ wage grade 6, step 1.  “Aye” votes ~ Falken, Negstad, Santema, Klavetter.  “Nye” votes ~ Larson.  Motion passes.

Deputy Auditor, Kelly Bakken presented the board with the Auditors Report.  Bakken updated the board on insurance matters.

Motion by Santema, seconded Negstad, to approve for recording purposes and authorize the chair to sign Resolution # 03-13.  The Resolution is for the Plat of Lot 1 of Egeberg Addition, in the NE1/4 of Section 29-110-50, Brookings County, South Dakota.  All voting “Aye.”

Salaries and personnel changes for the month of March 2003 are as follows: Longevity Increase:  Brenda Conn $45.00; Steve Groon $115.00; Steve Haro $35.00; Randy Ribstein $95.00; Janet Willmott $120.00; Shawna Vomacka $40.00. Salary Increases: Brenda Conn from $11.59 to $11.82.  Promotion:  Mike Erickson Truck Driver to Equipment Operator to pay grade 5 @ $11.29/hour.  Resignations/Retirements:  LeRoy Koepke, David Rusten, and C. Be it noted, the Highway transfers for the month of February 2003, $2,037.21 was transferred for expenditures to increase the Highway budget due to work performed and supplies furnished for various non-highway departments.

Commission Assistant/Personnel Director, Stephanie Vogel presented the board with the Commission Assistant/Personnel Director Report. Vogel updated the board on the HIPPA confidentiality information and presented a letter and resolution from the South Dakota Association of County Commissioners.  Motion by Falken, seconded by Santema, recommending that the LRC Executive Board select a study on tax exempt property and the criteria required to receive such property tax exemption as a topic for a legislative summer study.  “Aye” votes ~ Falken, Negstad, Santema, Klavetter.  “Nye” votes ~ Larson.  Motion passes.

Chair Klavetter updated the board on the 1st District meeting.

UNFINISHED BUSINESS
Be it noted, the board discussed grant information for the 1921 building and the possibility of adopting the Roberts Rules of Order.

ADJOURNMENT
The Chair declared the meeting adjourned until 8:30am Tuesday, April 8, 2003.
