BROOKINGS COUNTY COMMISSION MEETING
Tuesday, November 12, 2002

 The Brookings County Board of County Commissioners met in regular session on Tuesday, November 12, 2002, with the following members present: Emil Klavetter, Don Larson, Barb Telkamp, and Deanna Santema.  Sara Kneip was absent for personal reasons.  Also present: Stephanie Vogel, Kelly Bakken, Mary Negstad, Dennis Falken, Donna Ramsay, Keith Bruinsma, Don Endres, C. Beryle Sessions, Joyce Dragseth, Vicki Hanna, Janet Willmott, David Rusten.
 
Chairperson Emil Klavetter called the meeting to order.

APPROVAL OF AGENDA / MINUTES
Motion by Larson, seconded by Telkamp, to approve the agenda for November 12, 2002 meeting as amended.  All voting “Aye.”   Motion by Telkamp, seconded by Santema, to approve the minutes for the November 7, 2002 meeting approved as mailed.  All voting “Aye.”

COMMISSION REPORTS
Commissioner Santema reported on the tour of the Detention Center in Worthington, MN and on the Sheriffs Office Personnel Meeting.  Commissioner Larson reported on the East Central Mental Health Meeting. Commissioner Telkamp reported on the SERC Meeting, Multi Plex Board Meeting, Sheriffs Office Personnel Meeting, and helping in the Auditors Office Election Day. Commissioner Klavetter reported on the Planning & Zoning Meeting.

OTHER MATTERS
Motion by Telkamp, seconded by Larson, to approve the recommendations of the Brookings County Welfare Director for the following applications for County assistance.  All voting “Aye.”  Case # 02-010HSC for admission fee was approved.
 
 Motion by Larson, seconded by Telkamp to approve the following travel and education requests.  All voting “Aye.” Weed Department Employees, Gary Heldt, Lawrence Barnett, and Board Member, Bob Mans to go to Yankton, SD on November 14, 2002 to attend the District 2 Weed and Pest Annual Meeting.

 Deputy Auditor, Kelly Bakken presented the board with the Auditors Report.

Bakken submitted the following quotes for the Brookings County Highway Department for 10% Ethanol Gasoline: Ag First Coop, Volga $1.205; Cenex, Elkton $1.23; Martin Oil, Brookings $1.217.  Ag First Coop, Volga was awarded the quote at $1.205.  Diesel Fuel # 1 & #2: Ag First Coop, Volga $1.0575; Cenex, Elkton $1.05; Martin Oil, Brookings $1.031.  Martin Oil, Brookings was awarded the quote at $1.031.

Motion by Larson, seconded by Telkamp, to approve and authorize the chair to sign Resolution # 02-56.  The plat of VeraSun Third Addition in NW1/4, of Section 34-110-49, Brookings County, South Dakota.  All voting “Aye.”

Motion by Larson, seconded by Santema, to approve and authorize the chair to sign Resolution # 02-57.  The plat of DeBates Second Addition in NW ¼ of Section 33-110-51, Brookings County, South Dakota.  All voting “Aye.”

Commission Assistant/Personnel Director, Stephanie Vogel presented the board with the Commission Assistant/Personnel Director Report.  Be it noted, Vogel informed the board that Department of Revenue Tax Specialist, Kyle Helseth will determine the TIF District Base Value to be used as of November 1, 2002.
Chair Klavetter updated the board on County Highway 23 matters.

Extension Educators, Mel Kloster, Rose Stee, and Laurie Tangen met with the board to deliver their monthly report.  Be it noted, the board discussed the possibility of a Drought Disaster Declaration.

Treasurer, Vicki Hanna met with the board to update the board on the progress and to distribute the listing of Distress Warrants on Mobile Homes.

Highway Superintendent, Ted Eggebratten met with the board to discuss Highway matters.

Motion by Telkamp, seconded by Santema, approving and authorizing the Chair to sign the Access Road Easement for County Road 6.  All voting “Aye.”

Motion by Larson, seconded by Telkamp, approving and authorizing the Chair to sign the Certification and Approval of the Brookings Area Urban Boundary.  All voting “Aye.”

Motion by Larson, seconded by Santema, approving and authorizing the Chair to sign the Application For Occupancy on The Right of Way of County Highways.  Application made by Interstate Telecommunications Coop, Inc. for project # 538”50”.  All voting “Aye.”

Be it noted, the Board discussed bills that will be submitted at the end of 2002 for the Bridge project by Bushnell, SD.

Be it noted, Commissioner Telkamp inquired the progress of the Bus Barn Agreement with Brookings County.

 Motion by Telkamp, seconded by Santema, to go into executive session at 9:58am.  All voting “Aye.”  Chair Klavetter declared executive session over at 10:06am.  Reason – Contractual Matters.  No action at this time.  Also present:  Ted Eggebraaten and Wm. Mark Kratochvil.

Motion by Telkamp, seconded by Larson, to authorize the Highway Superintendent, Ted Eggebraaten to sign a contract for up to $1,300.00 with Geotek for the containment plan for the fuel tanks.  All voting “Aye.”

Motion to Santema, seconded by Telkamp, to authorize the payment of $3,000.00 to Paul Klapprodt for Right of Way land on County Road 2.  All voting “Aye.”

Robert Rysavy, Vice President with Banner Associates, Inc. met with the board to discuss the Court House Remodeling.  Motion by Larson, seconded by Telkamp, approving and authorizing the Chair to sign Change Order # 4. The contract has changed the following Request For Proposals: RFP# 6 Subject: Pipe Chase; RFP # 7 Subject: Carpet for the 2nd floor; RFP # 8 Subject: Repair rooms 2nd floor; RFP # 9 Subject: Magnetic lock; RFP # 10 Subject: Asbestos removal.  All voting “Aye.” Be it noted, the board requested that Banner Associates, Inc. keep the Court Officials and the State Historical Commission updated on the specifications and all Request For Proposals on the Construction Project.

Todd Meierhenry of Danforth, Meierhenry, & Meierhenry, LLP and Keith Bruinsma of VeraSun Energy met with the board to discuss the Resolution Providing For The Creation Of Tax Incremental District Number One, County Of Brookings.  Motion by Larson, seconded by Klavetter, to approve Resolution # 02-58.  Role Call Vote ~ Santema “Aye;” Larson “Aye;” Telkamp “Aye;” and Klavetter “Aye.”

RESOLUTION PROVIDING FOR THE CREATION OF TAX INCREMENTAL DISTRICT NUMBER ONE, COUNTY OF BROOKINGS

 WHEREAS, the Planning Commission has submitted a proposed project plan for Tax Incremental District Number One, County of Brookings and has recommended its creation.

THEREFORE, IT IS HEREBY RESOLVED:

Findings and Approval of Plan.  A hearing by the Planning Commission   concerning the creation and boundaries of the District was held on November 5, 2002.  The County finds that the plan is feasible and in conformity with the master plan of the County.  Pursuant to SDCL 11-9-17, the County hereby approves and adopts the project plan as submitted by the Planning Commission.
