The Brookings County Board of County Commissioners met in regular session on Tuesday, November 19, 2002, with the following members present: Emil Klavetter, Sara Kneip, Barb Telkamp, and Deanna Santema. Don Larson was absent for personal reasons. Also present: Stephanie Vogel, Kelly Bakken, Mary Negstad, Dennis Falken, Donna Ramsay, Doris Roden, Ted Eggebraaten, David Rusten, Lionel Torgrude, Joyce Dragseth, Mel Kloster, Vicki Hanna, Wm. Mark Kratochvil.
Chairperson, Emil Klavetter called the meeting to order.
APPROVAL OF AGENDA / MINUTES
Motion by Kneip, seconded by Telkamp, to approve the agenda for November
19, 2002 meeting as amended. All voting Aye. Motion by Telkamp,
seconded by Santema, to approve the minutes for the November 12, 2002 meeting
approved as mailed. All voting Aye.
DEPARTMENT HEAD REPORTS
Highway Superintendent, Ted Eggebraaten met with the board to discuss
Highway and Bridge matters. Be it noted, the board discussed the
Emergency Bridge Replacement located NE of Bushnell, SD; noting concerns
a land owner had with the size of the replacement bridge. Motion
by Kneip, seconded by Santema, to approve and authorize the chair to sign
the documents for the Brookings County Emergency Structure Replacement
# BRO-8006(40) PCEMS 318N. All voting Aye. Be it noted, Eggebraaten
updated the board on the County Highway Striping Project.
Zoning and Drainage Supervisor, David Rusten met with the board to discuss Zoning and Drainage permit matters.
Veterans and Welfare Director, Lionel Torgrude met with the board to discuss the TRIP Training Course; and to update the board on Welfare and Veteran Hospital concerns.
Deputy Director of Equalization, Joyce Dragseth met with the board to give an update on the Rural Review, ProVal Systems, Travel Information, and to present the board with the following Abatement Applications.
Motion by Kneip, seconded by Telkamp, to approve the Application of Abatement # 17-02 from Gary Madsen for the property described as N420 of S1030 of W320 of SW1/4 of Section 15-111-52. Tax Year 2001, Bill # 6027, Refund amount of $352.21. Reason: Ag Classification. All voting Aye.
Motion by Santema, seconded by Kneip, to approve the Application of Abatement # 18-02 from Brad Poss for a 1994 Clifton Mobile Home on Real Estate, Serial # 05945687134, located in Argo Township, Refund amount of $293.48. Reason: Mobile Home was totaled by a fire on June 13, 2002. All voting Aye.
Deputy States Attorney, Wm. Mark Kratochvil met with the board to correct a clerical matter.
OTHER MATTERS
Motion by Santema, seconded by Telkamp, to approve the recommendations
of the Brookings County Welfare Director for the following applications
for County assistance. All voting Aye. Case # 02-070ABC for
hospital was approved; Case # 02-148 for rent was approved; Case # 02-005AB
for rent was approved; Case # 02-135 for hospital was denied; Case # 02-137
for hospital was denied; Case # 02-047 for hospital was denied.
Motion by Kneip, seconded by Santema, to approve the following travel/education requests. Zoning and Drainage Supervisor, David Rusten to go to Sioux Falls, SD on November 22, 2002 to attend the South Dakota Planners Association Legislative Committee Meeting. Weed and Pest Department Employees: Gary Heldt, Elvin Lund, Meryln Jensen, Larry Barnett, and Gary Egeberg to go to Mitchell, SD on November 20, 2002 to attend the Van Deist Specialty Seminar on Herbicides, Insecticides, West Nile, and Noxious Weed Control. All voting Aye.
Deputy Auditor, Kelly Bakken presented the board with the Auditors Report.
Motion by Telkamp, seconded by Kneip, to change the Wheel Tax 2003 Highway Budget Line from line # 324 to line # 316. All voting Aye.
Motion by Santema, seconded by Telkamp, to automatically supplement for unanticipated expenses incurred and reimbursement made to Brookings County. Department: County Building Fund. Amount: $749,443.00. Reason: HVAC Johnson Controls Project, reimbursements received from First National Bank for funding. Receipt #s: 78464, 78465, 78463, 78997, 78928, 78929, 79134, 79212, 79213, 79324, 79702, 80056, and 80381. Line #: 30100X4295161. All voting Aye.
Be it noted, Register of Deeds statement of fees was filed in the County Auditors Office collected for the month of October 2002 in the amount of $20,914.00.
Be it noted, the Highway transfers for the month of October 2002, $2,908.61 was transferred for expenditures to increase the Highway budget due to work performed and supplies furnished for various non-highway departments.

Extension Educator, Mel Kloster met with the board to discuss the Emergency Drought Resolution. Motion by Kneip, seconded by Telkamp, to approved and authorize the chair to sign Resolution 02-60. All voting Aye.
Resolution # 02-60
WHEREAS, prevailing colder temperatures in April and May 2002 in South Dakota has caused slower growth in pasture and hay crops which caused the need to feed accumulated hay inventories for longer into the spring than the usual and customary practice; and,
WHEREAS, rainfall for the 2002 calendar year to date is average, but too late to promote adequate growth of pastures and forage in South Dakota thus causing pasture and hay fields to produce less feed; and,
WHEREAS, total cuttings of alfalfa and hay for the 2002 growing season in South Dakota are yielding an average of 40% of previous years yields for similar cuttings of hay and alfalfa;
THEREFORE BE IT RESOLVED that the Brookings County Board of Commissioners ask the Governor of the State of South Dakota and the President of the United States of America to declare Brookings County a disaster area to enable producers affected by adverse weather to participate in disaster programs for livestock producers for the year 2002.
The above and foregoing resolution was moved by Commissioner Kneip, seconded by Commissioner Telkamp.
Upon vote of the board all present voted aye; motion carried.

Treasurer, Vicki Hanna met with the board to discuss the possible use of credit cards in the Treasurers Office, Tax Deed Property, and the Mobile Home Distress Warrants Resolution. Motion by Santema, seconded by Telkamp, to approved and authorize the chair to sign Resolution 02-59. All voting Aye.

WHERES, South Dakota Codified Law (SDCL) 10-22-30 requires the County Treasurer to present a list of all distress warrants returned by the Sheriff uncollectable to the Board of County Commissioners. The board has examined such returns and, is satisfied with reports from Sheriffs and Treasurer that the taxes described in any such warrant cannot be collected.
NOW THEREFORE, BE IT RESOLVED by the Brookings County Commissioners, at a regular meeting November 19, 2002 direct the County Treasurer to place these mobile home taxes on an uncollectable list and no distress warrant shall therefore be issued until it is determined either by the Board of County Commissioners or the County Treasurer that such taxes have become or may have become collectable. There will be a complete listing of these uncollectable mobile home taxes on file in the Brookings County Treasurers office.

Commission Assistant/Personnel Director, Stephanie Vogel presented the board with the Commission Assistant/Personnel Director Report. The board discussed the agenda items for the upcoming joint meeting and a letter of request from Banner Associates, Inc.
Chair Klavetter updated the board on the Court House Remodel Project.
The board reviewed the balances of the 2002 Budget for all Departments.
