The Brookings County Board of County Commissioners met in regular session
on Tuesday, December 3, 2002, with the following members present: Emil
Klavetter, Sara Kneip, Don Larson, Barb Telkamp, and Deanna Santema. Also
present: Stephanie Vogel, Kelly Bakken, Mary Negstad, Eugene Miller, Doris
Roden, Donna Ramsay, Pat Fishback, Gloria Kloster, Doug Miller, Nancy Flynn,
Pat Garcia Duggan, Ted Eggebraaten, Todd Struwe, Joyce Dragseth, and Wm.
Mark Kratochvil.
Chairperson Emil Klavetter called the meeting to order.
APPROVAL OF AGENDA / MINUTES
Motion by Kneip, seconded by Telkamp, to approve the agenda for December
3, 2002 meeting as amended. All voting “Aye.” Motion by Telkamp,
seconded by Santema, to approve the minutes for the November 26, 2002 meeting
approved as amended. All voting “Aye.”
DEPARTMENT HEAD REPORTS
Highway Superintendent, Ted Eggebraaten met with the board to discuss
the Highway and Bridge matters. Be it noted, the board discussed
the possible clean up of a tree and rubbish pile compiled from the storm
in the city of Sinai. The board authorized Eggebraaten to proceed
with the clean up; and to use his discretion on the use of labor hours
and equipment to stay with in the Highway Budget.
Motion by Kneip, seconded by Santema, to approve and authorize the chair to sign the Application for Occupancy on the Right of Way of County Highways. The application made by Interstate Telecommunications Coop., Inc. for Project # 538”50”. All voting “Aye.”
Motion by Larson, seconded by Kneip, to approve and authorize the chair to sign the Application for Occupancy on the Right of Way of County Highways. The application made by Sioux Valley Energy. For Project # W.O.1858 located in Section 7-111-50. All voting “Aye.”
Emergency Management Director, Todd Struwe met with the board to discuss the State Radio Program.
Deputy Director of Equalization, Joyce Dragseth met with the board to discuss Departmental matters. Updating the board on technology upgrades, building permits, Ag land sales information, and the upcoming Open House.
OTHER MATTERS
Motion by Telkamp, seconded by Kneip, to approve the recommendations
of the Brookings County Welfare Director for the following applications
for County assistance. Case # 02-152 for utilities was approved; Case #
02-070ABCD for hospital was approved; Case # 02-011HSC for admission fee
was approved. All voting “Aye.”
Motion by Larson, seconded by Telkamp, to approve Resolution # 02-61. A Resolution Discharging Certain County Poor Liens Created Between January 1, 1973 to December 31, 2002. All voting “Aye.”
RESOLUTION # 02-61
DISCHARGING CERTAIN COUNTY POOR LIENS CREATED BETWEEN JANUARY 1, 1973 TO DECEMBER 31, 2002
WHEREAS, pursuant to SDCL 28-14-17, the Board of County Commissioners has the authority to release and discharge County Poor Liens; and
WHEREAS, at their regular Commission meeting of November 26, 2002, the Brookings County Board of County Commissioners did review by name all liens for collectibility from January 1, 1973 to December 31, 2002; and
WHEREAS, a list of the names and amounts deemed uncollectible by the County Commission has been prepared and reviewed by the Brookings County Welfare Office, the Brookings County Auditor’s Office and the Register of Deeds Office; and
WHEREAS, this list of uncollectible liens reflects any state hospital (Yankton, SD) involuntary commitment, $150.00 or less and no activity for 10 years, any death with no probate, keeping a 30 year window of activity on all other liens, and
WHEREAS, it would be beneficial to simplify the records by discharging such liens.
NOW, THEREFORE BE IT RESOVLED, that all Brookings County Poor Liens created between January 1, 1973 to December 31, 2002 previously reviewed by the Brookings County Commissioners are hereby discharged and the Brookings County Auditor and Brookings County Register of Deeds are directed to discharge such liens as identified on the list filed in the Brookings County Auditor’s Office.

Deputy Auditor, Kelly Bakken presented the board with the Auditors Report. Updating the board on the Festival of Lights Program.

Commission Assistant/Personnel Director, Stephanie Vogel presented the board with the Commission Assistant/Personnel Director Report. Updating the board on the HIPPA compliance, Risk Services review, and Departmental moving information.
Motion by Kneip, seconded by Telkamp, to approve and authorize the chair to sign the lease between Den-Wil Investments, Inc. and Brookings County for the Community Health Nursing Location. The lease is for the term of December 1, 2002 through November 30, 2004. All voting “Aye.”
Chair Klavetter updated the board on construction matters in the Court House.
Court Administrator, Pat Garcia Duggan updated the board on moving dates in conjunction with the Court House remodeling.
As scheduled, the board discussed the selection of a developer for the 1921 Building. Motion by Larson, seconded by Kneip, to recommend McCarthy Properties of Rapid City, SD to the Brookings Economic Development Corporation for the purposes of developing the 1921 Building. All voting “Aye.”
Be it noted, Finance Committee Director, Doug Miller inquired and requested a reference check on McCarthy Properties of Rapid City, SD.
Motion by Larson, seconded by Kneip, to work with the Brookings Economic Development Corporation, to proceed with the development of 1921 Building, and to authorize the chair to initiate discussions on the matter. All voting “Aye.”
Todd Meierhenry of Danforth, Meierhenry, & Meierhenry, LLP and Keith Bruinsma of VeraSun Energy met with the board to discuss the Environmental Tax Exempt Bond Finance. A Resolution was presented to the board and to Deputy States Attorney, Wm. Mark Kratochvil for review, and it will be presented to the board for possible action at the next scheduled Commission meeting. Also present: Wm. Mark Kratochvil.
Commissioner Telkamp updated the board on the upcoming Juvenile Justice Board Meeting and discussed the bill that was deleted for the last claim cycle for Comfort Heating & Cooling for thermostats checking at the Multi-Plex. The bill will be paid on the next claim cycle.
Motion by Telkamp, seconded by Kneip, to go into executive session
at 10:12am. All voting “Aye.” Chair Klavetter declared executive
session over at 11:55am. Reason - Personnel Matters. No action
at this time.
ADJOURNMENT
The Chair declared the meeting adjourned until 9:00am Tuesday, December
10, 2002.
