The Brookings County Board of County Commissioners met in regular session on Tuesday, September 17, 2002, with the following members present: Emil Klavetter, Sara Kneip, Don Larson, and Barb Telkamp. Ray Santema was absent for medical reasons. Also present: Stephanie Vogel, Kelly Bakken, Mary Negstad, Eugene Miller, Dennis Falken, David Hicks, Wm. Mark Kratochvil, C. Beryle Sessions, David Rusten, Wallace Tvedt, Doris Roden, Donna Ramsay, Gloria Kloster, and Rick Eggebrecht.
Chairperson Emil Klavetter called the meeting to order.
APPROVAL OF AGENDA / MINUTES
Motion by Larson, seconded by Telkamp, to approve the agenda for September
17, 2002 meeting as amended. All voting “Aye.” Motion by Telkamp,
seconded by Kneip, to approve the minutes for the September 10, 2002 meeting
approved as amended. All voting “Aye.”
COMMISSION REPORTS
Commissioner Larson reported on the East Central Mental Health Board
Meeting. Commissioner Telkamp reported on the Brookings Area Transit Meeting,
Auditors Office Meeting, and the Planning Session for the South Dakota
Coalition for Children. Commissioner Kneip reported on a Director of Equalization
Meeting. Commissioner Klavetter reported on the Planning & Zoning Meeting
and Weed Board Meeting.
OTHER MATTERS
Motion by Larson seconded by Kneip, to approve the recommendations of the Brookings County Welfare Director for the following applications for County assistance. All voting “Aye.” Case #02-007HSC for admission fee was approved.
Motion by Larson, seconded by Kneip to approve the following travel/education requests. All voting “Aye.” Rose Marie Stee to go to Madison, SD on September 25, 2002 to attend the FEU Meeting; to go to Montrose, SD on September 26, 2002 to attend the Character Counts Training.
Deputy Auditor, Kelly Bakken presented the board with the Auditors Report.
Be it noted, Register of Deeds statement of fees was filed in the County Auditor’s Office collected for the month of August 2002 in the amount of $25,791.00.
Bakken submitted the following quotes for the Brookings County Highway Department for #2 Prem. Diesel: Ag First Coop, Volga $.898; Cenex, Elkton $.888; Martin Oil, Brookings $.894. Cenex, Elkton was awarded the quote at $.888.
Commission Assistant/Personnel Director, Stephanie Vogel presented the board with the Commission Assistant/Personnel Director Report.
Motion by Larson, seconded by Telkamp, to authorize the Chair to sign the agreement with the State of South Dakota Public Facilities Program Grant by and between the Governor’s Office of Economic Development and Brookings County. All voting “Aye.”
Be it noted, the Board reviewed the Resolutions for the State Convention.
Highway Superintendent, Ted Eggebraaten met with the board to discuss County Road and Bridge matters.
Motion by Larson, seconded by Telkamp, to declare and to authorize the Chair to sign the Emergency Replacement letter for Bridge # 06-250-137 located in Alton Township of Brookings County. Be it noted, the bridge replacement will comply with the State Bid Contracts. All voting “Aye.”
Motion by Larson, seconded by Kneip, to authorize the Chair to sign the Agreement to Fund Construction of Project P 6317(00), PCN, in Brookings County. This agreement is made by and between the South Dakota Department of Transportation and Brookings County. Subject: Project P 6317(00) Grading, Structures, Base Course, and PCC paving from Junction of US14 North of Aurora, SD., South to SD324. All voting “Aye.” Also present: Wm. Mark Kratochvil.
Motion by Telkamp, seconded by Kneip, to authorize the Chair to sign the Employment Agreement Between Brookings County and Banner Associates, Inc., Consulting Engineers of Brookings, SD., for Professional Engineering Services for Brookings County Highway 23 Improvements located in Brookings County, SD. All voting “Aye.” Also present: Daryl Englund and Dennis B. Micko of Banner Associates, Inc.

A RESOLUTION AUTHORIZING THE PURCHASE OF A
WHEEL LOADER BASED UPON THE PRICE AND TERMS
ESTABLISHED THROUGH THE COUNTY OF GREGORY,
SOUTH DAKOTA, BID PROCESS
WHEREAS, the Brookings County Highway Department needs a new Wheel Loader; and
WHEREAS, the COUNTY OF GREGORY, SOUTH DAKOTA, has recently gone through a competitive bidding process for wheel loaders, such bidding process culminating in the bids being opened on September 25, 2001; and approved on October 16, 2001; and
WHEREAS, BUTLER MACHINERY COMPANY was the lowest responsible bidder under such COUNTY OF GREGORY, SOUTH DAKOTA, bid process and BUTLER MACHINERY COMPANY is willing to sell a 2003 Caterpillar Model 950 G Wheel Loader to BROOKINGS COUNTY under the same terms and options as available to the COUNTY OF GREGORY, a copy of such bid specifications and bid having been filed at the Brookings County Auditor’s Office; and
WHEREAS, pursuant to SDCL 5-18-18, BROOKINGS COUNTY is authorized to purchase equipment form upon the lowest responsible bidder of an item competitively bid by another local government entity at the bid price or less.
WHEREAS, Caterpillar Wheel Loaders have an historically greater re-sale value; retain their value; are of higher quality and dependability than other wheel loaders, and generally cost less to operate.
NOW THEREFORE, BE IT RESOLVED that the Brookings County Highway Department
is hereby authorized and directed to purchase one 2003 Caterpillar Model
950 G Wheel Loader from BUTLER MACHINERY COMPANY based upon the bid price,
or less, as established through the competitive bidding process of the
COUNTY OF GREGORY, with the unit and specifications as follows:

With all standard equipment and the following options:

ADOPTION OF 2003 ANNUAL BUDGET
FOR BROOKINGS COUNTY, SOUTH DAKOTA
Whereas, (7-21-5 thru 13), SDCL provides that the Board of County Commissioners shall each year prepare a Provisional Budget of all contemplated expenditures and revenues of the County and all its institutions and agencies for such fiscal year and,
Whereas, the Board of County Commissioners did prepare a Provisional Budget and cause same to be published by law, and
Whereas, due and legal notice has been given to the meeting of the Board of County Commissioners for the consideration of such Provisional Budget and all changes, eliminations and additions have been made thereto.
NOW THEREFORE BE IT RESOLVED, that such provisional budget as amended and all its purposes, schedules, appropriations, amounts, estimates and all matters therein set forth, SHALL BE APPROVED AND ADOPTED AS THE ANNUAL BUDGET OF THE APPROPRIATION AND EXPENDITURES FOR BROOKINGS County, South Dakota and all its institutions and agencies for calendar year beginning January 1, 2003 and ending December 31, 2003 and the same is hereby approved and adopted by the Board of County Commissioners of Brookings County, South Dakota, this 17th day of September, 2002. The Annual Budget so adopted is available for public inspection during normal business hours at the office of the County Auditor, Brookings County, South Dakota. The accompanying taxes are levied by Brookings County for the year January 1, 2003 through December 31, 2003.

Treasurer, Vicki Hanna met with the board to discuss Distress Warrants on Mobile Homes and to distribute Bank Quotes on Interest.
Motion by Larson, seconded by Telkamp, to reconsider the following motion made on Tuesday, September 10, 2002. All voting “Aye.” Motion by Telkamp, seconded by Larson, to approve the low quote of $4,456.00 for fencing supplies from United Building Centers of Brookings, SD. The fencing supplies will be used to fence the cemetery located in section 35 of Brookings Township. Be it noted, the bill will be paid out of the Commissioners budget. All voting “Aye.”

Auditor, Jan Willmott met with the board to discuss Personnel Matters and the TIF District.
Zoning and Drainage Supervisor, David Rusten met with the board to discuss a Land Farming Resolution. Motion by Larson, seconded by Telkamp, to adopt and authorize the chair to sign Resolution # 02-51. All voting “Aye.”

Brookings County Commission
WHEREAS, Wallace Tvedt desires to establish a landspreading or solid waste operation for the purpose of solid waste management; and
WHEREAS, the siting of this proposed facility is not in conflict with any established zoning laws or ordinances; and
WHREAS, Wallace Tvedt will file a solid waste application with the South Dakota Department of Environment and Natural Resources (DENR); and
WHEREAS, DENR will review that application to determine that the facility can be operated within the South Dakota laws and regulations; and
WHEREAS, DENR may recommend the approval of the permit with conditions adequate to safeguard the environment; and
WHEREAS, the Board of Minerals and Environment will review, modify, approve, or deny the permit if the tentative recommendations and/or conditions of the permit are contested by any interested party; and
WHEREAS, the County Commission of Brookings County is required by South Dakota law SDCL 34A-6-1-3 to approve of a solid waste facility prior to the issuance of a solid waste permit;
IT IS THEREFORE RESOLVED that the County Commission of Brookings County hereby approves construction and operation of the proposed facility to be operated under the terms of a solid waste permit to be issued by the Board of Minerals and Environment.
